Understanding Employee Invention Law and Inventor Remuneration
When an invention is made in the course of an employment relationship, companies and employees need to understand the rights and obligations arising under German Employee Invention Law. Key questions include: When does an invention fall within the scope of the law? How must an invention be disclosed? How is a service invention claimed, and what obligations arise for the employer?
This webinar provides a practical overview of the legal framework governing employee inventions and addresses the most important issues that arise in day-to-day practice. Using selected examples, participants will gain a better understanding of the procedures and principles involved in handling service inventions and related inventor compensation.
A particular focus is placed on the inventor's right to remuneration. Inventor remuneration represents the economic compensation for the use of an employee invention. At the same time, transparent and appropriate remuneration arrangements can support employee motivation and contribute to a company's innovative capacity.
From Invention Disclosure to Compensation
You will gain an overview of the systematics of Employee Invention Law and the key steps involved in dealing with employee inventions. This includes the scope of application, invention disclosure and claiming, as well as obligations relating to patent protection and the offering of rights to the inventor.
The webinar also introduces the main principles used to determine inventor remuneration. Participants will learn about the remuneration formula, relevant calculation methods and the role of remuneration agreements.
The License Analogy Method
A key focus of the webinar is the License Analogy Method, which is an important approach to determining inventor remuneration.
You will learn about the relevant factors involved in this method, including the technical and economic reference value, the determination of appropriate royalty rates, gradation and the participation factor.
The webinar also addresses specific practical situations, such as remuneration for inventions that are not used, licensed to third parties or sold. In addition, participants will gain an overview of particular issues that may arise when inventions are used within a group of companies.
